TERMS &
CONDITIONS OF BUSINESS SERVICE CHARGES - Our Service Charge is 8.33% below General
Manager level and 12.5% for and above General Managers of annual gross salary
excluding PF and retirement/terminal benefits but would include HRA or value
of company leased accommodation and all allowances given in that form to
reduce the income tax burden. PAYMENT - Payment of our service charges have to be made
within 30 days of the candidate joining your organisation. In case of delay
beyond 5 days of the prescribed limit, we would be charging Rs 200 per day as penalty surcharge in accordance with
the Indian Finance Act. All outstation companies would have to send the
payment by a demand draft payable at GUARANTEE - We provide a free replacement guarantee of 3
months. This can be increased to 6 months by your agreeing to a surcharge of
25%. If a candidate actually ceases employment, irrespective of when he has
given notice or indicated his intention to cease employment with the
organisation, after 90 days of commencement of employment, for what so ever
reason, the agency will not be held responsible and no payments will be
deducted from unpaid bills or future bills. This guarantee becomes invalid if
the penalty surcharge is not paid or Terms agreed to by the company with our
candidate, in writing or verbally are not adhered to and if the candidate
leaves the payment would still have to be made and in case of delayed payment
the penalty surcharge has to be paid. This clause is not applicable against
overseas employments. OWNERSHIP - The resumes sent to you against a requirement
remain our property. Should you select
someone from these resumes against any subsequent requirement or should a
candidate be rejected by you and later selected through a walk-in interview
or a candidate declines to join your organisation currently but later
approaches you directly and joins your organisation will be considered to be
a placement done by us and service charges as mentioned in clause #1 will
have to be borne by you. NO SOURCE GAURANTEE - We give you a guarantee that we will
not source for personnel from your organisation. This would not cover your
employees coming to us on their own against our advertisements or having
heard about our organisation. SERVICE TAX - The organisation will have to bear this tax as
this is a government levy. Currently, it has been fixed at 12.24%. BOND - Should the organisation intend to sign a bond with the candidate, this has to be given in writing to us at the time of giving the requirement and has to be indicated in the offer letter, a copy of which has to be given to us. Should it be not there in the offer letter and subsequently the candidate is asked to sign the bond and the candidate leaves, the GUARANTEE CLAUSE will not apply. |
